This document outlines the Terms and Conditions governing your use of Neoplus.ae, including membership registration, benefits, and event participation facilitated through the platform. It details the rights, obligations, and guidelines associated with the Membership Program. By enrolling in or utilizing any part of our Membership Program, you agree to these Terms, thereby entering into a binding contract with Najahi Events.

Definitions

"NAJAHI" refers to Najahi Events Organization LLC, a premier event organizing entity and provider of Neoplus.ae membership program.

"Member" denotes an individual or entity that has registered for the NAJAHI Membership Program, accepting the Terms and Conditions herein.

"Neoplus.ae Membership Program" encompasses the array of benefits, services, and experiences offered to Members by NAJAHI, including but not limited to access to exclusive events, vouchers, and discounts.

"Voucher" is a benefit issued to Members as part of the Membership Program, which can be redeemed for discounts or access to services and events up to a certain value.

By accepting this Agreement, you confirm your understanding and consent to abide by these Terms, ensuring a fruitful and enjoyable membership experience with NAJAHI.

Neoplus.ae Membership Program offers an enriching array of benefits designed to elevate your experience with exclusive access to premier events and services. For an annual fee of 3000 AED, members gain access to a suite of carefully curated benefits, aimed at providing unparalleled value and opportunities.

Details on Membership Vouchers

Upon enrollment, members are allocated vouchers, central to maximizing the Neoplus.ae Membership Program experience. These vouchers are structured as follows:

One 100% Voucher: Redeemable for full access to an event of choice, capped at a value of $1000, ensuring members can experience our most sought-after events.

One 50% Voucher: Offering half-off on any event priced up to $1000, providing a discount of up to $500, this voucher is designed for those seeking flexibility in their event participation.

Five 10% Vouchers: Each allows for a 10% discount on events priced up to $1000, perfect for regular engagement with a variety of our offerings.

It's important to note, vouchers are not applicable for VIP events or any event where the ticket price exceeds the original value of the voucher. This ensures fair access to our diverse event portfolio for all members.

Membership Card and Discounts at Outlets

In addition to event access, members receive a Membership Card that opens the door to exclusive discounts at over 80 partner outlets across the UAE. From dining and wellness to entertainment and shopping, these benefits are selected to enhance your lifestyle and provide savings across a wide range of services.

Collaboration with Other Event Organizers

Expanding our network, NAJAHI partners with esteemed event organizers, offering members discounted access to a broader spectrum of events. Whether it’s workshops, social gatherings, or educational seminars, membership ensures you are a part of a vibrant community with a shared passion for exclusive experiences.

Payment Terms

Investment Sum and Payment Procedure

Neoplus.ae Membership Program offers exceptional value through its comprehensive benefits package. The annual membership fee is 3000 AED, payable upon registration. This fee grants access to the membership benefits outlined, including a range of vouchers and discounts across various events and partner outlets.

Payment of the membership fee is due in full at the time of registration.

Payment for tickets and memberships is exclusively conducted online through our platform, Neoplus.ae. We ensure a secure and efficient payment process to facilitate your transactions smoothly.

Memberships are automatically renewed using the credit card provided at the time of the initial membership sign-up. By accepting these terms and conditions, members agree to this automatic renewal process.

Membership Use and Limitations

Limitations on the Use of Membership Benefits

The benefits associated with the Neoplus.ae Membership Program, including access to events and discounts at partner outlets, are specifically tailored for personal use by the registered member only. The resale or transfer of these benefits to others is strictly prohibited to ensure fairness and exclusivity for all members.

Members must comply with the terms and conditions of each benefit, which may include expiration dates, event-specific restrictions, and applicable conditions at partner outlets. It's imperative that members review and adhere to these conditions to fully enjoy their membership benefits.

Exclusions and Restrictions

Certain premium or VIP events may be excluded from the voucher benefits, emphasizing the exclusivity and unique value offered to attendees of these events. Members should consult the specific terms of their vouchers for details on any exclusions.

In cases where an event's cost exceeds the maximum value of a voucher, members are responsible for covering the difference. This policy ensures that members have access to a wide range of events while maintaining the integrity of the voucher system.

Member Responsibilities

Members are encouraged to regularly check the website or contact customer service for updates on event availability, new partner outlets, and changes to terms and conditions. Staying informed allows members to maximize their benefits and avoid any misunderstandings regarding the use of vouchers and membership card discounts.

Feedback and inquiries regarding membership benefits, event experiences, or suggestions for new partnerships are always welcome. Najahi values member input as a crucial part of continually enhancing the Membership Program.

Refunds and Cancellations

Conditions for Refunds

Membership cancellations are permitted, whereby the automatic renewal of the membership will be discontinued. Refunds for the remaining membership term are not applicable nor do they apply.

Cancellation by Najahi

Najahi reserves the right to cancel a membership due to misconduct by a member.

In such instances, the member will be notified in writing. Refunds for the remaining membership term are not applicable nor do they apply.

Liability and Indemnification

Limitation of Liability

Najahi Events Organization LLC endeavors to provide a high-quality experience to all its members. However, it's important to note that:

Najahi shall not be liable for any direct, indirect, incidental, special, or consequential damages that result from the use of, or the inability to use, the membership benefits, including but not limited to, access to events and partner outlet discounts.

Liability is limited to the extent permitted by law, and in no event shall Najahi's total liability to you exceed the amount of the membership fee paid.

Force Majeure Events

Najahi will not be considered in breach of its obligations or liable for any delay, failure in performance, or interruption of service resulting directly or indirectly from acts of God, civil or military authority, acts of public enemy, war, riots, civil disturbances, insurrections, accidents, fire, explosions, earthquakes, floods, strikes, pandemics, governmental regulations, or any other cause beyond Najahi's reasonable control.

Indemnification by Members

Members agree to indemnify, defend, and hold harmless Najahi, its directors, officers, employees, agents, licensors, and suppliers from and against all losses, expenses, damages, and costs, including reasonable attorneys' fees, resulting from any violation of these Terms and Conditions or any activity related to the member’s account (including negligent or wrongful conduct) by the member or any other person accessing the membership benefits using the member's account.

General Provisions

Notices and Communication

All communications related to the membership, including any notices or updates about the Membership Program, will be delivered through the contact information provided by the member at the time of registration. Members are responsible for maintaining up-to-date contact information in their membership profile to ensure they receive all communications from Najahi.

Amendments and Variations

Najahi reserves the right to amend these Terms and Conditions at any time. Any changes will be effective immediately upon posting on the Neoplus.ae website or direct communication to members. Continued use of the membership benefits after such changes signifies the member’s acceptance of the revised Terms and Conditions.

Entire Agreement Clause

These Terms and Conditions constitute the entire agreement between Najahi and the member regarding the Neoplus.ae Membership Program and supersede all prior understandings, agreements, representations, or communications, whether written or oral.

No Guarantees/Warranties

Najahi makes no guarantees or warranties, expressed or implied, regarding the specific outcomes or benefits that members might expect from their membership. The actual benefits available may vary based on factors including but not limited to availability, partnerships, and member engagement.

Privacy and Consent

Najahi is committed to protecting the privacy of its members. Personal information collected during the registration process and throughout the membership period is used for the administration of membership benefits, communication of offers and events, and improvement of services. Najahi ensures that all personal data is handled in accordance with applicable privacy laws and regulations.

Consent to Contact By accepting these Terms and Conditions, members consent to receive communications from Najahi, including newsletters, offers, and information about upcoming events via email, SMS, or other communication methods. Members have the right to opt-out of receiving these communications at any time by updating their preferences in their membership account or contacting customer service.

Data Sharing Najahi may share member data with third-party partners solely for the purpose of providing enhanced membership benefits, such as discounts and access to exclusive events. Any sharing of data will be done in compliance with privacy laws, and Najahi will ensure that partners have adequate data protection policies in place.

Miscellaneous

Governing Law and Jurisdiction

The Terms and Conditions of Neoplus.ae Membership Program shall be governed by and construed in accordance with the laws of the United Arab Emirates. Any disputes arising out of or in connection with this agreement will be subject to the exclusive jurisdiction of the courts of the United Arab Emirates, ensuring that all legal proceedings, if necessary, are conducted within a familiar legal framework.

Severability

If any provision of these Terms and Conditions is found to be invalid, illegal, or unenforceable, the validity, legality, and enforceability of the remaining provisions shall not in any way be affected or impaired. Najahi will amend or replace such provisions with ones that are valid, legal, and enforceable and that achieve, to the greatest extent possible, the original objectives and intent.

Waiver

No waiver by Najahi of any breach or default hereunder shall be deemed to be a waiver of any preceding or subsequent breach or default. The failure of Najahi to exercise or enforce any right or provision of these Terms and Conditions shall not constitute a waiver of such right or provision.

Modification of Neoplus.ae Membership Program

Najahi reserves the right to modify, suspend, or discontinue the Neoplus.ae Membership Program, including any services or benefits offered, at any time without notice. Members will be notified of significant changes to the program and have the option to continue or cancel their membership based on the new terms.

متفرقات

القانون الحاكم والاختصاص القضائي

تخضع شروط وأحكام برنامج العضوية Neoplus.ae نجاحي للقوانين المعمول بها في الإمارات العربية المتحدة وتفسر وفقًا لها. تخضع أي نزاعات تنشأ عن هذه الاتفاقية أو فيما يتعلق بها للاختصاص الحصري لمحاكم الإمارات العربية المتحدة، مما يضمن إجراء جميع الإجراءات القانونية، إذا لزم الأمر، ضمن إطار قانوني مألوف.

القابلية للفصل

إذا وُجد أن أي بند من بنود هذه الشروط والأحكام غير صالح أو غير قانوني أو غير قابل للتنفيذ، فلن يؤثر ذلك بأي حال من الأحوال على صحة أو قانونية أو قابلية تنفيذ البنود المتبقية. ستقوم نجاحي بتعديل أو استبدال مثل هذه البنود بأخرى صالحة وقانونية وقابلة للتنفيذ والتي تحقق، قدر الإمكان، الأهداف والنوايا الأصلية.

Ownership and Rights

Najahi Events Organization LLC retains all intellectual property rights in the content, materials, and other assets related to events organized directly by Najahi. This includes but is not limited to any digital content, promotional materials, logos, and trademarks associated with Najahi's own events. Members and participants are granted a non-exclusive, non-transferable license to access and use such materials solely for personal, non-commercial purposes, in accordance with the Terms and Conditions of the Neoplus.ae Membership Program.

Third-Party Events

For events not directly organized by Najahi but made accessible to members through partnerships or collaborations, Najahi does not claim any ownership of the intellectual property rights of these third-party events. Responsibility for intellectual property compliance rests with the respective event organizers. Members are advised to review and comply with any intellectual property conditions or restrictions imposed by these third parties.

تحتفظ منظمة نجاحي للفعاليات ذ.م.م بجميع حقوق الملكية الفكرية في المحتوى والمواد والأصول الأخرى المتعلقة بالفعاليات التي تنظمها نجاحي بشكل مباشر. يشمل ذلك ولكن لا يقتصر على أي محتوى رقمي، مواد ترويجية، شعارات، وعلامات تجارية مرتبطة بفعاليات نجاحي الخاصة. يُمنح الأعضاء والمشاركين ترخيصًا غير حصري وغير قابل للتحويل للوصول إلى هذه المواد واستخدامها لأغراض شخصية غير تجارية، وفقًا لشروط وأحكام برنامج العضوية Neoplus.ae.

الفعاليات التابعة لجهات خارجية

بالنسبة للفعاليات التي لا تنظمها نجاحي بشكل مباشر ولكن يتم الوصول إليها من قبل الأعضاء من خلال شراكات أو تعاونات، لا تدعي نجاحي أي ملكية لحقوق الملكية الفكرية لهذه الفعاليات التابعة لجهات خارجية. تقع مسؤولية الامتثال للملكية الفكرية على عاتق منظمي الفعاليات المعنيين. يُنصح الأعضاء بمراجعة والامتثال لأي شروط أو قيود متعلقة بالملكية الفكرية يفرضها هؤلاء الأطراف الثالثة.

Event Cancellation

In the event of the cancellation of an event, the ticket buyer will be notified via email. The ticket buyer has the right to either receive a credit equivalent to the amount paid for the ticket or request a refund. Refunds will be processed within 30 to 60 banking days and will be issued directly to the card used for the ticket purchase. For purchases made via cash or bank transfer, refunds will be issued via wire transfer.

إلغاء الحدث

في حال إلغاء الحدث، سيتم إخطار المشتري عن طريق البريد الإلكتروني. يحق للمشتري الحصول على رصيد يعادل المبلغ المدفوع مقابل التذكرة أو طلب استرداد المبلغ. سيتم معالجة طلبات الاسترداد خلال 30 إلي 60 يومًا مصرفيًا وسيتم إصدارها مباشرة إلى البطاقة المستخدمة في شراء التذكرة. بالنسبة للمشتريات التي تمت نقدًا أو عن طريق التحويل البنكي، سيتم إصدار الاسترداد عن طريق التحويل البنكي.

Event Postponement

In the event of the postponement of an event, the ticket buyer will be notified via email regarding the new event date. The ticket buyer has the option to retain the same ticket for use on the new date or request a refund. If a refund is requested, the ticket will be voided, and a refund will be processed within 30 to 60 banking days. Refunds will be issued directly to the card used for the ticket purchase or via wire transfer for purchases made via cash or bank transfer.

تأجيل الحدث

في حال تأجيل الحدث، سيتم إخطار المشتري عن طريق البريد الإلكتروني بخصوص تاريخ الحدث الجديد. لدى المشتري خيار الاحتفاظ بنفس التذكرة لاستخدامها في التاريخ الجديد أو طلب استرداد المبلغ. إذا تم طلب استرداد المبلغ، سيتم إلغاء التذكرة وسيتم معالجة طلب الاسترداد خلال 30 إلي 60 يومًا مصرفيًا. سيتم إصدار الاسترداد مباشرة إلى البطاقة المستخدمة في شراء التذكرة أو عن طريق التحويل البنكي بالنسبة للمشتريات التي تمت نقدًا أو عن طريق التحويل البنكي.
